Building Near Easements & Surcharge Rules

Building over or adjacent to registered utility easements (sewer mains, stormwater pipes, electrical cables) invalidates exempt development pathways and triggers strict engineering design controls.

Building Over Sewer or Stormwater Invalidates Exempt Status

Regardless of wall height or deck area, you cannot build within an easement or within the zone of influence of a water authority main without formal approval (e.g. Sydney Water 'Building Over or Adjacent to Assets' / Yarra Valley Water / Urban Utilities consent).

Understanding the 45-Degree Angle of Repose (Zone of Influence)

When structural footings (for a retaining wall, garage, or deck) are placed near an underground pipe, they impart weight into the soil. If that weight falls within the Zone of Influence (typically a 45° angle extending upwards from the invert/base of the pipe), it can crush the pipe or lead to collapse during pipe maintenance.

The Golden Rule for Footings Near Pipes:

Footings for any retaining wall or structure located adjacent to an easement must be drilled below the 45° line of influence down to solid bedrock or undisturbed natural ground. This ensures that even if the utility authority excavates the entire pipe for replacement, your structure will remain structurally self-supporting.

4 Steps Before Building Near Easements

01. BYDA

Before You Dig Australia

Lodge an online enquiry at byda.com.au to obtain free underground asset plans for your property.

02. Pegging

CCTV & Service Locating

Engage a professional utility locator to electronically trace and mark the exact depth and alignment of sewer lines.

03. Engineering

Pier Footing Design

Provide pipe depth to your structural engineer to detail pier depths socketed below the invert of the pipe.

04. Consent

Water Authority Stamping

Submit engineering plans to your regional water retailer (Sydney Water Tap in, South East Water, etc.) for formal consent.
