Contractor Licensing & Consumer Safety
Verify active trade licenses, audit statutory warranty insurance, and check maximum legal deposit limits before signing any residential construction contract in Australia.
Statutory 4-Point Contractor Audit
Do not transfer advance payments until all 4 criteria are met
1. Verify Active Licence Online
Check the state public register to confirm the licence is active, registered under their business entity/ABN, and not suspended.
2. Licensing Threshold Triggers
Contracts exceeding state dollar thresholds ($3.3k in QLD, $5k in NSW/ACT, $10k in VIC, $12k in SA/NT, $20k in WA/TAS) legally require a registered licence.
3. Job-Specific Warranty Insurance
Demand the site-specific policy certificate (HBCF, DBI, QBCC, HII) before paying any deposit. General public liability does not cover insolvency.
4. Legal Deposit Caps
Contractors asking for 20% to 50% upfront violate state legislation. Most statutory domestic limits are strictly capped between 5% and 10% (6.5% in WA).

Home Building Compensation Insurance
If a builder becomes insolvent, dies, or disappears before completing your build or rectifying major structural defects, government statutory compensation funds step in. It is illegal for a contractor to accept deposits without furnishing a job-specific policy certificate.
