Terms of Use
Please read these terms carefully before accessing or using BuildCheck AU (the “Platform”).
BuildCheck AU provides general cost benchmarks, statutory summaries, and planning threshold references for educational purposes only. We are not a registered private building certifier, structural engineer, municipal authority, or legal advisory firm. Always confirm zoning overlays, bushfire ratings (BAL), and exempt development criteria with your relevant Local Government Area (LGA) or private certifier before breaking ground.
1. Acceptance of Terms
By accessing, browsing, or using BuildCheck AU, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, our Privacy Policy, and any additional guidelines posted on the Platform. If you do not agree to these terms, you must not use the Platform.
2. Cost Calculators & Benchmark Estimates
Cost calculations produced on BuildCheck AU rely on mathematical modeling indexed against the Building and Construction General On-site Award [MA000020] CW3 labor rates and estimated material supplier figures.
- Calculations do not represent binding quotes or contractual guarantees.
- Site-specific variables—such as subsurface rock, high water tables, steep topography, narrow boundary access, or regional freight levies—can alter actual contractor quotes substantially.
- All pricing benchmarks exclude statutory council headworks contributions, formal soil classification tests, and survey drafting fees unless explicitly noted.
3. Trade Contractor Matching & Disclaimers
BuildCheck AU connects property owners with third-party trade contractors, commercial sponsors, and affiliate partners. BuildCheck AU:
- Is not a party to any contract, agreement, or transaction entered into between a property owner and a trade contractor.
- Does not warrant, guarantee, or insure the workmanship, timeliness, licensing status, or structural integrity of works executed by listed or matched contractors.
- Requires homeowners to independently verify contractor licenses (via state registers like NSW Fair Trading, Victorian Building Authority (VBA), or Queensland Building and Construction Commission (QBCC)) and demand proof of valid Public Liability and Home Building Compensation Fund (HBCF) insurance.
4. Commercial Sponsors & Affiliate Monetization
In compliance with Australian Consumer Law (ACL), we disclose that BuildCheck AU receives compensation via commercial sponsorships (e.g., LGA-exclusive trade listings) and performance affiliate links (e.g., third-party quoting aggregators). Outbound affiliate links are tagged with rel=“sponsored” or rel=“nofollow”.
5. Limitation of Liability
To the maximum extent permitted by law, BuildCheck AU, its operators, officers, and affiliates will not be liable for any direct, indirect, incidental, punitive, or consequential damages resulting from your use of the Platform, reliance on statutory compliance summaries, or engagement of any third-party trade contractor.
6. Governing Law
These Terms of Use are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.
